Stamen Design LLC (referred to here as “Stamen” or “we” or “us” or “our”) values our customers and respects your privacy.

Stamen as a Processor for its Clients

When providing our services to clients, we receive personal information related to our client’s users, and other third parties. When a client chooses to use our services, we strictly follow their instructions in collecting (if applicable) and processing such personal information. We do not use or share such client data for any purposes outside of providing the services to the client.

Please note that in relation to processing of client data, Stamen is considered as a data processor or service provider. The client is the controller and the one assuming responsibility for the processing of personal data through our services. Our use of personal information on behalf of our clients is governed by our contract with that client, general data processing terms and the client’s own privacy policy.

Scope of This Privacy Policy

This Privacy Policy (“Policy”) applies to Stamen’s offline and online data collection practices, including when you visit our website at stamen.com, https://hi.stamen.com/, maps.stamen.com, fieldpapers.org, mapstack.stamen.com and any website owned, operated, or controlled by us (collectively the “Site”), our blog, create an account on the Site, subscribe to receiving communications from us by joining our data viz community, contact us by phone or email or when you engage with us on social media or interact with our marketing communications.

We may update this Policy from time to time, as specified in the “Changes to This Privacy Policy” section below.

Your Consent

You should read this entire Policy before submitting information to us or using our Site. Whenever you submit personal information to us, you consent to the collection, use, disclosure, transfer and storage of that information in accordance with this Policy.

We may make full use of all information that is de-identified, aggregated, or otherwise not in personally identifiable form.

Information Collection and Use by Stamen

We collect personal information about you in the following ways: (1) from you when you choose to voluntarily provide it; (2) using automated technology, including when you visit our Site or interact with our advertisements or communications; and (3) third party sources, including but not limited to service providers, entities providing data analysis and analytics, advertising, social media and social networking websites and other entities. Automated technology collects information from your computer or mobile device and includes cookies, web beacons, local shared objects, or other similar technology. All personal information may be used for the purposes stated in this Policy. We may combine data collected from third party sources.

We collect, use, and disclose your personal information as described in the chart in Annex 1 below.

Legal Basis for Processing Personal Information under the General Data Protection Regulation (GDPR)

If you are a resident of the European Economic Area (EEA), Stamen’s legal basis for collecting and using the personal information described in this Policy depends on the personal information we collect and the specific context in which we collect it. In addition, we process personal information with the principle of data minimization in mind. This means that we limit ourselves to the minimum amount of personal information which is needed to achieve the particular purpose for which we process the personal information.

Stamen’s legal basis for processing include:

· The processing is necessary to perform a contract with you;

· The processing is necessary for the legitimate interests of our business, including but not limited to managing our business, improving our services, fraud prevention, information security, direct marketing, or to comply with the law;

· To fulfill a legal obligation;

· You have provided consent for us to do so.

We will retain your personal information (collected through offline and online methods) for as long as it is necessary for the purposes described in this Policy. We will also retain and use your personal information to the extent necessary to comply with our legal obligations, resolve disputes, and enforce our legal agreements and policies.

We have implemented technical and organizational security measures designed to secure our personal information from loss, misuse and unauthorized access, disclosure, alteration or destruction, whether in transmission or storage. Stamen takes preventative measures against malware and hacking.

Please keep in mind, however, that there is no such thing as perfect security, and no Internet transmission is ever completely secure or error-free. Although we strive to protect your personal information in accordance with this Policy, we will not be liable for disclosure of personal information obtained due to errors in transmission or security breaches.

Cookies and other automated technology

We may make available third party applications through our Site, blog and social media applications for your use. Links to such applications, any other websites included in this Site or links on our social media accounts operate with privacy policies beyond our control. Unless otherwise indicated, once you have left our Site or our social media account, all use of information you provide is governed by the privacy policy of the other website’s or social media account’s operators. We are not responsible for any transactions that occur between you and a third-party website or social media account.

Email Marketing

If you no longer wish to receive email marketing communications from us, you may opt-out of receiving marketing-related emails by clicking on the “unsubscribe” link in the email to unsubscribe or sending us an email at legal@stamen.com. Please note that unsubscribing from our promotional material will not prevent us from contacting you for other reasons, such as in connection with any services we are providing to you, in response to your inquiry, etc.

Intended Audience of Site; COPPA Compliance

We are in compliance with the requirements of the Children’s Online Privacy Protection Act (“COPPA”) and other applicable privacy laws. Our Site, social media accounts and online activities are not directed to children under the age of 16. As a result, our website does not request or knowingly collect personal data from individuals under the age of 16 or elsewhere. If you are not 17 or older, you should not visit or use our Site. If you become aware that a child has provided us with personal information without appropriate consent, then please contact us using the details below so that we can take the appropriate steps in accordance with our legal obligations and this Policy.

California Do Not Track Notice

Because there are not yet common, industry accepted “do not track” standards and systems, our website does not respond to Do Not Track signals. In addition, we may allow third parties to collect personal information from your activity on our website, as described in the “Information Collection and Use” section above and as described in Annex 1 below.
